Former GOP presidential candidate and AI Tax founder John Anthony Castro—known nationally for his lawsuit seeking to disqualify Donald Trump under Section 3 of the 14th Amendment—has reported a significant development in his federal appeal.

Castro’s presidential ambitions and high-profile legal battle were derailed when he was convicted on tax-related charges. He has consistently maintained that he is innocent and that his conviction was the result of prosecutorial misconduct. Castro has been actively appealing the case, arguing that key evidence was hidden and that federal prosecutors colluded with witnesses to secure his conviction.

According to new information provided to The Neoliberal Journals by Castro and his legal team, the government has conceded to a Sixth Amendment violation—specifically acknowledging that prosecutors withheld evidence that should have been disclosed. Castro further alleges that the government offered a witness a criminal immunity deal that was never disclosed to the defense, and that prosecutors declined to respond to this allegation in their latest filings.

Castro’s team says he will file his reply on Monday, along with an emergency motion requesting immediate release pending the outcome of the appeal.

This remains a developing story.
